S. Blanensk\u00e1, s. r. o. Jde o pozemky, na nich\u017e stoj\u00ed zch\u00e1tral\u00e9 sklen\u00edky a kter\u00e9 maj\u00ed b\u00fdt zastav\u011bny obchodn\u00edm centrem. Do patn\u00e1cti dn\u016f od zve\u0159ejn\u011bn\u00ed z\u00e1m\u011bru m\u016f\u017ee ve\u0159ejnost pod\u00e1vat p\u0159ipom\u00ednky. T\u00e9to mo\u017enosti vyu\u017eil Petr Kavka z Blanska a svoje vyj\u00e1d\u0159en\u00ed poskytl t\u00e9\u017e redakci Monitoru:<\/strong><\/p>\n\n\n\n<p>\t\u201eNa \u00favod jako ob\u010dan m\u011bsta vyjad\u0159uji sv\u00e9 osobn\u00ed stanovisko, \u017ee nesouhlas\u00edm, aby p\u0159edm\u011btn\u00e9 pozemky byly v budoucnu p\u0159evedeny kter\u00e9koliv osob\u011b za \u00fa\u010delem vybudov\u00e1n\u00ed obchodn\u00edho (n\u00e1kupn\u00edho) centra. Vyu\u017eit\u00ed t\u00e9to lokality spat\u0159uji, d\u00edky um\u00edst\u011bn\u00ed v z\u00e1topov\u00e9 oblasti, sp\u00ed\u0161e v pokra\u010dov\u00e1n\u00ed m\u00e9n\u011b n\u00e1ro\u010dn\u00e9 zem\u011bd\u011blsk\u00e9 \u010dinnosti anebo pro volno\u010dasov\u00e9 aktivity ob\u010dan\u016f nejen na\u0161eho m\u011bsta. P\u0159\u00edpadn\u00e9 stavebn\u00ed objekty navrhuji koncipovat tak, aby na nich mo\u017en\u00e1 povode\u0148 nenap\u00e1chala velk\u00e9 materi\u00e1ln\u00ed \u0161kody, tj. vydl\u00e1\u017ed\u011bn\u00e9 \u010di vyasfaltovan\u00e9 dr\u00e1hy, pr\u016flezky, pokud budova tak men\u0161\u00edho p\u016fdorysu\u2026&nbsp;<\/p>\n\n\n\n<p>\tV dal\u0161\u00ed f\u00e1zi tohoto textu ji\u017e p\u0159ejdu ke konkretizaci p\u0159ipom\u00ednek:<\/p>\n\n\n\n<p>\t<strong>a) opakovan\u00e9 prodlou\u017een\u00ed term\u00edn\u016f <\/strong>\u2013 oba z\u00e1m\u011bry pova\u017euji za neur\u010dit\u00e9, nebo\u0165 nenab\u00edzej\u00ed \u017e\u00e1dnou konkr\u00e9tn\u00ed lh\u016ftu, o n\u00ed\u017e se odkl\u00e1d\u00e1 spln\u011bn\u00ed z\u00e1vazk\u016f na stran\u011b developera. Pod\u00edv\u00e1m-li se na celkovou genezi t\u00e9to akce, pak m\u011b dlouhodob\u00fd postup m\u011bsta vede k z\u00e1v\u011bru, \u017ee neust\u00e1l\u00e9 prodlu\u017eov\u00e1n\u00ed term\u00edn\u016f, v nich\u017e m\u00e1 developer splnit n\u011bjakou povinnost, nen\u00ed pro m\u011bsto v\u00fdhodn\u00fd \u010di minim\u00e1ln\u011b nen\u00ed \u0159\u00e1dn\u011b od\u016fvodn\u011bno, pro\u010d m\u011bsto opakovan\u011b \u201evylep\u0161uje\u201c pozici developera na sv\u016fj \u00fakor. Uzav\u0159en\u00ed p\u016fvodn\u00ed smlouvy \u010d. 2015\/000650\/INV\/OS je datov\u00e1no dnem 22. 5. 2015 a zve\u0159ejn\u011bn\u00edm z\u00e1m\u011br\u016f se vytv\u00e1\u0159\u00ed p\u0159edpol\u00ed pro uzav\u0159en\u00ed ji\u017e \u0161est\u00e9ho dodatku b\u011bhem p\u011bti let. Obstoj\u00ed takov\u00fd postup m\u011bsta p\u0159i konfrontaci se z\u00e1sadou p\u00e9\u010de \u0159\u00e1dn\u00e9ho hospod\u00e1\u0159e? Osobn\u011b se domn\u00edv\u00e1m, \u017ee postup m\u011bsta je ji\u017e na sam\u00e9 hran\u011b t\u00e9to z\u00e1sady a mo\u017en\u00e1 u\u017e i malinko za n\u00ed. Nem\u011bla by b\u00fdt tahle opakuj\u00edc\u00ed se situace ji\u017e podn\u011btem k tomu, aby se hledalo jin\u00e9 v\u00fdchodisko, ne\u017e znovu napln\u011bn\u00ed z\u00e1vazk\u016f developera odkl\u00e1dat? O pozemky se mnoho let nikdo prakticky nestar\u00e1, v\u0161e tam postupn\u011b ch\u00e1tr\u00e1. Je tohle p\u00e9\u010de \u0159\u00e1dn\u00e9ho hospod\u00e1\u0159e? M\u00e1 m\u011bsto n\u011bjak\u00fd finan\u010dn\u00ed prosp\u011bch z tohoto majetku? To jsou jist\u011b alespo\u0148 n\u011bkter\u00e9 z ot\u00e1zek, kter\u00e9 si racion\u00e1ln\u011b uva\u017euj\u00edc\u00ed \u010dlov\u011bk polo\u017e\u00ed;<\/p>\n\n\n\n<p>\t<strong>b) cena v dan\u00e9m m\u00edst\u011b a \u010dase obvykl\u00e1 <\/strong>&#8211; \u00a7 39 odst. 2 z\u00e1kona o obc\u00edch nastavuje striktn\u00ed pravidlo, kdy p\u0159i \u00faplatn\u00e9m p\u0159evodu m\u00e1 b\u00fdt cena sjedn\u00e1na zpravidla ve v\u00fd\u0161i, kter\u00e1 je v dan\u00e9m m\u00edst\u011b a \u010dase obvykl\u00e1. Odchylka sm\u011brem dol\u016f mus\u00ed b\u00fdt zd\u016fvodn\u011bna, jinak je takov\u00e9 pr\u00e1vn\u00ed jedn\u00e1n\u00ed (tedy smlouva) absolutn\u011b neplatn\u00e9. Nem\u00e1m nejmen\u0161\u00ed pochybnosti o skute\u010dnosti, \u017ee v roce 2015, kdy byly p\u0159edm\u011btn\u00e9 smlouvy schvalov\u00e1ny, by sjednan\u00e9 ceny v tomto z\u00e1konn\u00e9m testu obst\u00e1ly.&nbsp; Obstoj\u00ed ale tyto ceny po\u017eadavku z\u00e1kona i v dob\u011b, kdy dojde k uzav\u0159en\u00ed realiza\u010dn\u00edch smluv? Mezi t\u011bmito dv\u011bma okam\u017eiky toti\u017e uplynulo ji\u017e minim\u00e1ln\u011b 5 let a t\u0159i m\u011bs\u00edce a nikdo nev\u00ed, kolik dn\u00ed, m\u011bs\u00edc\u016f a rok\u016f je\u0161t\u011b uplyne. Faktor plynut\u00ed \u010dasu pova\u017euji za podstatnou pr\u00e1vn\u00ed skute\u010dnost. Smlouvy o smlouv\u00e1ch budouc\u00edch obsahovaly lh\u016fty, kdy se o\u010dek\u00e1valo uzav\u0159en\u00ed realiza\u010dn\u00edch smluv, proto p\u0159edpokl\u00e1d\u00e1m, \u017ee i ceny za p\u0159evod tomu odpov\u00eddaly. Lh\u016fty pro\u0161ly a z ve\u0159ejn\u00fdch zdroj\u016f nem\u00e1m informace o tom, \u017ee by \u201em\u00ed\u010d byl na stran\u011b m\u011bsta\u201c. Ceny nemovit\u00fdch v\u011bc\u00ed na trhu mezit\u00edm raketov\u011b rostly. Rovnov\u00e1ha smluv se d\u00edky odsunu lh\u016ft vychyluje sm\u011brem k v\u00fdhodnosti pro developera a ochran\u011b jeho majetkov\u00fdch hodnot. M\u011bsto m\u00e1 ale prioritn\u011b bojovat za pot\u0159eby sv\u00fdch ob\u010dan\u016f nikoliv za z\u00e1jmy podnikatelsk\u00e9ho subjektu, kter\u00fd bezpochyby do projektu investoval spoustu pen\u011bz, \u00fasil\u00ed a \u010dasu. Jsem toho n\u00e1zoru, \u017ee d\u00edky zna\u010dn\u00e9mu \u010dasov\u00e9mu posunu realizace cel\u00e9 akce by m\u011blo b\u00fdt otev\u0159eno i jedn\u00e1n\u00ed o kupn\u00edch cen\u00e1ch a v\u00fd\u0161i n\u00e1jemn\u00e9ho, jinak se zastupitel\u00e9 m\u011bsta vystavuj\u00ed riziku, \u017ee nedostoj\u00ed p\u00e9\u010di \u0159\u00e1dn\u00e9ho hospod\u00e1\u0159e s mo\u017en\u00fdmi nep\u0159\u00edzniv\u00fdmi n\u00e1sledky v rovin\u011b trestn\u00edho pr\u00e1va a sou\u010dasn\u011b m\u016f\u017ee doj\u00edt k napaden\u00ed platnosti realiza\u010dn\u00edch smluv u soudu, nebo\u0165 sjednan\u00e9 ceny neodpov\u00eddaj\u00ed po\u017eadavk\u016fm \u00a7 39 odst. 2 z\u00e1kona o obc\u00edch.
