Sv\u016fj pod\u00edl na dluz\u00edch v\u0161ak Spe\u0161ov odm\u00edt\u00e1 uznat. D\u011bjstv\u00ed druh\u00e9 Blansko se do\u017eaduje splacen\u00ed dluhu M\u011bsto Blansko trv\u00e1 na zaplacen\u00ed dluhu a pod\u00e1v\u00e1 k tehdej\u0161\u00edmu Okresn\u00edmu \u00fa\u0159adu Blansko (tedy m\u00edstn\u00edmu z\u00e1stupci st\u00e1tu) n\u00e1vrh na v\u00fdkon rozhodnut\u00ed ministerstva, neboli na exekuci. Blansko v\u0161ak nepova\u017euje tento n\u00e1rok za opr\u00e1vn\u011bn\u00fd, nebo\u0165 povinnost nov\u011b vznikl\u00e9 obce pod\u00edlet se na pasivech vypl\u00fdv\u00e1 p\u0159\u00edmo ze z\u00e1kona o obc\u00edch, a po\u017eadovanou \u010d\u00e1stku odm\u00edt\u00e1 uhradit. Spe\u0161ov tedy v roce 2010 pod\u00e1v\u00e1 na Blansku \u017ealobu na zaplacen\u00ed t\u00e9to \u010d\u00e1stky s p\u0159\u00edslu\u0161enstv\u00edm z d\u016fvodu bezd\u016fvodn\u00e9ho obohacen\u00ed \u2013 Blansko dle t\u00e9to \u017ealoby zadr\u017euje finan\u010dn\u00ed prost\u0159edky z\u00edskan\u00e9 neopr\u00e1vn\u011bnou exekuc\u00ed. D\u011bjstv\u00ed \u010dtvrt\u00e9 Blansko v defenziv\u011b M\u011bsto Blansko soudu navrhuje zam\u00edtnut\u00ed \u017ealoby s t\u00edm, \u017ee Spe\u0161ov se po odd\u011blen\u00ed mus\u00ed pod\u00edlet tak\u00e9 na pasivech obce, od kter\u00e9 se odd\u011blil, a trv\u00e1 na tom, \u017ee povinnost zaplatit dluh vypl\u00fdv\u00e1 p\u0159\u00edmo ze z\u00e1kona o obc\u00edch, nebo\u0165 nelze nab\u00fdt na z\u00e1klad\u011b jednoho rozhodnut\u00ed majetek, ale z\u00e1rove\u0148 nenab\u00fdt z\u00e1vazky.
